MEMBERSHIP TERMS AND CONDITIONS
1) Please read these Terms and Conditions, along with your Membership Handbook issued upon joining to ensure you get the best out of your Membership. The Membership Handbook provides all of the additional information you may need to fully enjoy your membership.
2) You may be entitled to use all the facilities within Trafford Community Leisure Trust. Please refer to your Membership Handbook to confirm Membership category and entitlement. The Member may use the facilities from time to time starting from the date on the face of this membership agreement until such a time they wish to discontinue the Membership, provided they are not in arrears in respect of any instalment due to Trafford Community Leisure Trust (The Trust) or in breach of any of the other conditions.
3) Certain packages have time restrictions. Further details are set out in the Members Handbook.
4) Your Membership is personal to you and you cannot transfer it to another person. You must not lend your membership card to another person. If another person uses your membership card, we may end your membership.
5) All Members will be required to present their membership card at reception on each visit.
6) The Member will punctually pay The Trust (without previous demand) the agreed sum found in the DD amount box of the payment details, by instalment within 3 working days of the dates set out in Part 2 of the schedule.
7) A. Payment Options
· Annual Membership is paid in full 12 months in advance of the start of the membership. This Membership is non-refundable outside of the cooling off period, which is 14 days from the start date in the face of this Agreement.
· Fixed Membership is an annual commitment. An annual commitment is a minimum of 12 monthly payments by direct debit. A Member may choose to terminate his/her Membership after 12 months; A Member can do this by giving one month's written notice to The Trust. Steps must be taken by the Member to cancel the direct debit.
B. All cancellations must be submitted in writing to The Trust. It is your responsibility to ensure that all correspondence is received by The Trust. You will receive confirmation if your last payment.
C. If the bank returns a failed payment on your account, we will write to you about the failure and the reason for it. Outstanding monthly instalments must be paid promptly.
D. Cancelling your Direct Debit Instruction does not mean that you have given us notice to end your Membership. You must give the appropriate written notice as set out above (7A, 7B).
8) From time to time we will need to contact you about your membership. It is important you let us know if your personal details change.
9) Any notice or other information required or permitted to be given by either party under this agreement shall be deemed to have been validly given if served personally upon that party or if sent by first class pre-paid post to the address of that party as stated overleaf or to his/her last known address. Any notice or other information sent by first class pre-paid post shall be deemed to have been received by the other party within 48 hours after the date of posting.
10) Fraudulent or wrongful information given in order to obtain a discounted Membership will result in the cancellation off all Membership rights and any action deemed necessary by the Trust
· The Trust may disclose personal particulars contained in the Membership Agreement to a credit reference agency or any other party necessary in obtaining the settlement arrears.
· Trafford Community Leisure Trust is registered under the Consumer Credit Act 1974. The terms of this agreement do not infringe upon any other right legally enjoyed by the customer under the terms of the Consumer Legislation or the Direct Debit Guarantee.
11) On production of a registered Doctor's certificate proving that a Member has:
· Suffered serious injury or illness; or
· Become pregnant
The Trust can, in its discretion, allow you to withhold full payment of the monthly instalments for a maximum of nine months in any one calendar year. A request for the suspension of a Membership must be submitted in writing to The Trust, with accompanying medical evidence, starting the suspension period required. It is your responsibility to keep The Trust informed if you wish to extend your suspension period. In this instance, extra evidence will be required. You will not be allowed to use your membership if it has been suspended. Remaining monthly instalments must be paid once the suspension period has expired. An administrative fee of £5 per month will be chargeable and deducted through Direct Debit (if any), and such payment will not form any part of any agreed minimum number of payments.
12) Memberships may be terminated by the Management either for violation of any rule or regulation of the centre as stated or advised from time to time or for conduct deemed unreasonable by the Trust to be detrimental to the welfare , good order or character of the Centre and/or its Members or without cause. The Trust will not tolerate verbal or physical threats or abuse made to any member of staff.
13) A. The Trust reserves the right to alter, change, add to, reduce or increase various centre facilities and to utilise the centre facilities for special events, private parties, seminars, tournaments or other activities that may be deemed desirable. The Trust will endeavour to give 14 days notice where possible.
B. The Centre's normal hours of opening and the hours in which any facility in the Centre is available to Members can be obtained from the Member's Handbook. Such hours may be varied from time to time with or without prior notice depending on the circumstances.
14) The Trust is not responsible for the loss of personal items or damage to personal items and/or property or injury to the Member in any facility or on any facility areas, centre parking or grounds. Equipment stored in lockers is entirely at the owners own risk.
15) You are only entitled to use the Centre's car parks while using the centre's facilities.
16) By signature of the Membership Agreement the Member confirms that they are physically and medically fit and agrees that neither the Trust or the Centre will be responsible for injury, accident or loss suffered by the Member. You must not do strenuous physical activities without first seeking medical advice is you have concerns about your medical condition. You are responsible for monitoring your own physical condition. If you suffer any unusual symptoms, you must stop the activity immediately and tell a members of staff.
17) The Member hereby agrees that they will use the centre's facilities and its grounds entirely at their own risk and that neither the Trust nor the Centre shall have liability whatsoever, whether in tort or in contract, for any loss, injury or damage whatsoever sustained by them. The Member accepts full responsibility for their use of all facilities, appliances, privileges or services whatsoever at their own risk and indemnifies and holds harmless the centre and the Trust or its directors, officers, employees, representatives, agents or lessons, from any and all loss, claim, injury, damage or liability sustained or incurred by the member or their property howsoever caused unless caused wholly by the default or neglect of the Trust.
18) It may be necessary to undertake essential maintenance to the facility and its equipment at any time. Every attempt will be made to provide advance notice and to minimise disruption and inconvenience. The Trust reserves the right to offer recompense only in the event of full and prolonged closure.
19) The Trust endeavour to give you 14 days notice of any variation to the Terms and Conditions of this Membership Agreement (this may include Membership price changes etc).
20) All personal details submitted to The Trust will be held in accordance with our responsibilities under the Data Protection Act 1998 (the act) which applies in the UK. The Trust will not pass on your details to third parties.
21) Dress Code must be adhered to.
22) Smoking is not allowed.
23) The Membership Terms and Conditions form your Membership agreement.
